Someone sitting in the apex of Malaysia’s courts must have the gall and intellectual honesty to answer the issue on which court has the final authority to interpret and decide with finality the provisions of the Constitution and legislations passed by Parliament and the State Assemblies, regardless if the name of the law is Islamic or otherwise. Until the court accepts this responsibility, our country cannot hope to progress peacefully and maintain religious harmony. The Rule of Law in a constitutional democracy demands that the Judiciary be protective of the nation’s subjects be they, I would say especially, the poor, the marginalised and the minorities.The Courts must act with courage to protect the Constitutionally guaranteed rights of all
citizens, even if to do so were to invoke the wrath of the government of the day.
